The essentials, on one screen

This does not replace the full text, but it is what really matters:

1. Who we are and what you are accepting

1.1. Arbo ("Arbo", the "App", the "Service") is a mobile application and its associated server, developed and operated by Better Planet LLC, a New Mexico limited liability company, with its address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA ("Better Planet", "we", "us").

1.2. By creating an account, downloading, installing or using Arbo, you accept these Terms and Conditions (the "Terms") and the Privacy Policy, which forms an integral part of this agreement. If you do not agree, do not use the Service.

1.3. Definitions.

1.4. The Terms are an agreement between the User and Better Planet. Apple Inc. and Google LLC are not parties to this agreement, although Annex A gives them certain rights when the App is downloaded from the App Store.

2. Who can use Arbo

2.1. Minimum age to hold an account: 18. Only a person who is of legal age under the law of their country of residence may create and manage an account.

2.2. Authority over the child. When you register a Child you declare that:

a) you are their mother, father, legal guardian or the person who has their personal care, or that you are acting with the express authorisation of someone who is; and b) you have the legal right to record and process that minor's data, including their health data; and c) where the law requires it or where the child is old and mature enough, you have explained to them what the App stores and you have taken their views into account.

Better Planet does not verify and cannot verify that relationship. The declaration is yours, and so is the responsibility for it being true.

2.3. Use by minors. Some parts of the App are meant for the Child to use under supervision (the games and lessons of the little ones' mode) or for a teenager to answer directly (the guided conversation about career orientation). That use happens under your supervision and under your responsibility, and in the teenager's case, only if he or she agrees to take part.

2.4. Invited accounts. The main account can invite other caregivers (the other parent, grandparents, a guardian). By inviting someone you are giving them access to the household's Children's data, and you are answerable for that decision. Check who you invite.

2.5. Credentials. You are responsible for keeping your password and your device secret and safe. Tell us straight away at hola@arbofamily.com if you suspect that someone has got in without permission.

3. What Arbo is — and what it is NOT

This is the most important section in the document. Read all of it.

3.1. Arbo is a family notebook

Arbo is a tool for personal record-keeping and companionship: it stores what the family decides to write down about their children's lives and gives it back in an orderly form, as an album, a timeline and a few charts.

3.2. Arbo is NOT a medical device

Arbo is not a health product, it is not a medical device, it has not been assessed or authorised by any health authority — not by Chile's Instituto de Salud Pública, not by the United States FDA, not by any other — and it is not intended to diagnose, treat, cure, mitigate or prevent any illness or condition.

In particular, Arbo does not:

Nothing Arbo shows you is medical advice. If you have any doubt about a child's health, development, feeding, sleep, behaviour or mood, talk to a health professional. In an emergency, call the emergency services (Chile: 131 SAMU · 133 Carabineros · 132 Fire Service) or go to the nearest emergency department. Never delay or give up seeking medical care because of something you saw or read in Arbo.

3.3. Growth curves and percentiles (WHO)

3.3.1. Arbo plots the height and weight measurements you record onto the LMS reference tables of the World Health Organization (Child Growth Standards 2006 for ages 0–5 and the 2007 Reference for older ages), and calculates percentiles and z-scores using the WHO's own method.

3.3.2. Those curves are a statistical population reference, not a clinical assessment of your child. A low or high percentile does not on its own mean that anything is wrong, and a "normal" percentile does not rule out that something is.

3.3.3. Arbo does not adjust for prematurity, for genetic syndromes or conditions, for the parents' height, for ethnic origin, for chronic conditions or for any other individual circumstance. A growth curve can only be interpreted by a health professional with the child in front of them.

3.3.4. The accuracy of the chart depends entirely on the accuracy of what you measured and wrote down. Arbo does not validate your measurements.

3.3.5. Better Planet is not responsible for decisions taken on the basis of a curve, a percentile or a comparison shown in the App.

3.4. Medication reminders — READ THIS CAREFULLY

3.4.1. What they are. When you record a treatment (name, how many hours between doses and for how many days), the App schedules local notifications on your phone as a memory aid. Nothing more. They are reminders, not a medication administration system.

3.4.2. Reminders CAN FAIL AND NOT ARRIVE. This is not a remote possibility: it is expected behaviour for any notification on a mobile phone. Among other causes, a reminder may fail to appear, appear late or disappear if:

a) the phone is switched off, out of battery, restarting or in airplane mode; b) the user did not grant notification permission, revoked it, or the system revoked it through disuse; c) the phone is in Do Not Disturb, focus mode, silent mode, power saving or sleep mode; d) iOS limits an app to 64 pending local notifications: Arbo only schedules the doses for the next 48 hours and renews that window every time you open the app. If you do not open Arbo, the reminders beyond that window do not exist; e) Android or the phone manufacturer applies battery optimisation, "app hibernation", automatic closing of background apps or the manufacturer's own restrictions; f) the operating system groups, summarises, silences or delivers late the notifications (scheduled summaries, focus modes, delayed delivery); g) the user uninstalled and reinstalled the app, changed phone, restored a backup, changed the device's time or time zone, or signed out; h) there was a bug, an operating system change, an update or a failure of the Service itself.

3.4.3. DOSING IS THE CAREGIVER'S RESPONSIBILITY. Arbo does not check the medicine, the dose, the frequency, the duration, the interactions, the allergies, the contraindications, or whether the medicine is right for that child, for their age or for their weight. Arbo repeats exactly what you typed, even if it is wrong. The right prescription comes from the doctor and is carried out by the caregiver.

3.4.4. Do not depend on the App. For treatments where a missed, doubled or mistimed dose could cause harm, use an independent method (an alarm clock, a pill organiser, a paper chart, more than one adult in charge). Better Planet is not answerable for missed, doubled, late or early doses, nor for their consequences, whatever the cause.

3.4.5. Reminders for birthdays, for taking measurements, for developmental milestones and for the career compass are subject to exactly the same limitations.

3.5. Artificial intelligence adviser and career orientation

3.5.1. How it works. The "adviser" and the analysis of the guided career-orientation conversation use a third-party language model (the Claude API, from Anthropic PBC). When you use them, part of the child's history is sent to that third party in order to generate the answer. Exactly what is sent is set out in the Privacy Policy.

3.5.2. The generated content may be wrong. Language models can produce information that is mistaken, out of date, incomplete, biased or simply made up, even when it sounds confident and well written. Better Planet does not review, does not validate and cannot guarantee the accuracy, the suitability or the safety of any answer.

3.5.3. It is guidance to talk about, not an instruction. The parenting suggestions, the readings of emotions, the RIASEC aptitude profiles, the suggested careers and the glimpses of the future are not psychological assessments, nor valid psychometric tests, nor certified career guidance, nor a verdict on what a young person should study or become.

3.5.4. The decision is yours. You decide what to do with what the App suggests, and you are answerable for that decision. Always check with a professional before acting on anything important.

3.5.5. Mental health. If you, your child or anyone in your care is at risk, do not use the App: get professional help immediately or call the emergency services. In Chile, Salud Responde 600 360 7777. The App does not detect crises, does not handle emergencies and does not alert anyone.

3.5.6. The adviser may be switched off, stop being available, change model or change provider at any time, without notice.

3.6. Tracker chip

3.6.1. IT IS NOT A SAFETY DEVICE AND NOT AN EMERGENCY DEVICE. Arbo's tracker module is a log of positions reported by a third-party device. It is not, and does not claim to be: an alarm system, a panic button, an anti-kidnapping device, an emergency location service, a real-time monitoring system with a service guarantee, or a substitute for an adult's supervision.

3.6.2. We do not use it to watch over anyone or to respond. Better Planet does not monitor the positions it receives, does not generate automatic alerts, does not warn anyone if a device stops reporting or shows up somewhere unexpected, and has no emergency response service.

3.6.3. It can fail. The position shown may be out of date, imprecise, wrong or missing altogether, among other reasons because of: no network coverage, a flat battery, a lost or damaged chip, a GPS error, network delay, the server or the hosting going down, or the child simply not carrying the device.

3.6.4. Third-party hardware. Better Planet does not manufacture, does not sell, does not certify and does not endorse any chip, wristband, pendant or physical device. The App's module only generates a device code and stores whatever that device sends. Any problem with the hardware, coverage, battery or accuracy belongs to the device's manufacturer and operator, not to us.

3.6.5. Lawful use. Tracking a person without the legal right to do so can be a crime. By using this module you declare that you have that right in respect of that minor. Do not use Arbo to track adults, or children whose personal care you do not have.

3.6.6. If a child is lost or in danger, call the police immediately. Do not waste time looking at the App.

3.7. Educational content, tips and "little ones' mode"

3.7.1. The games, stories, lessons, parenting tips and age-based content are general material for entertainment and stimulation, not a school curriculum, nor an educational assessment, nor a learning diagnosis, nor therapy.

3.7.2. The "talents" and the skill maps the App draws from play are a playful reading of activity inside the App. They do not measure intelligence, aptitude or school performance.

3.7.3. The age ranges are indicative. You decide which content is right for your child, and you supervise how it is used.

3.8. Identity verification by photo (optional)

3.8.1. If this feature is switched on, Arbo can compare a selfie of the adult caregiver with the photo on their ID document using a third-party service (Amazon Rekognition).

3.8.2. The result is an automated biometric comparison against a similarity threshold. It can produce false positives and false negatives. The "verified" badge on a profile is not a guarantee of identity and not a background check, and must not be used as a reason to trust anyone.

3.8.3. It is voluntary: you can use Arbo without it.

3.9. Circle, chat and direct messages

3.9.1. The Circle has two conversations: the neighborhood chat, between adults from different families who share a neighborhood code, and direct messages between two of those adults. Children take part in neither.

3.9.2. We do moderate. An automatic filter blocks messages containing language that does not belong in the Circle before they are sent; anyone can report a message or block another person, and reports reach a panel where the team reviews them and can delete the message for everyone. Photos that are uploaded go through a content filter. What we do not do is read conversations routinely: we only see what someone reports.

3.9.3. What you write is stored on the server and visible to the recipients. Do not write anything there that you would not want on the record.

4. User Content: it is yours, and you are answerable for it

4.1. Ownership. User Content is yours. We claim no ownership over the photos, the texts, the measurements or any data you enter.

4.2. Limited licence. You grant us a non-exclusive, worldwide, royalty-free, revocable and strictly limited licence to host, store, back up, transmit, process and display your own Content to you, for the sole purpose of operating the Service for you. This licence does not include training artificial intelligence models on your Content, or publishing it, or selling it, or handing it over for advertising or commercial purposes, and it ends when you delete the Content or your account, except for backup copies while they run through their normal rotation cycle.

4.3. Accuracy. You are answerable for the data you enter being correct: dates of birth, measurements, allergies, diagnoses, medicines, doses, schedules and any other data. The App validates none of it. A mistake of yours is reflected exactly as it is in the charts, in the reminders and in what is sent to the AI adviser.

4.4. Right to record. You declare and warrant that you have the right to record in Arbo every piece of data about every person you enter — including a minor's health data, and other adults' data (for example, when you invite someone or mention them in a note). If you do not have that right, do not enter it.

4.5. Third-party data. Do not upload photos or data of children who are not in your care without the authorisation of whoever is entitled to give it.

4.6. Prohibited content. Do not use Arbo to store or transmit illegal content, child sexual abuse material, or content that infringes the rights of others. We will report to the authorities any child abuse material we become aware of, and we will close the account.

4.7. We may remove content that breaches these Terms or the law, with no obligation to review anyone's content proactively.

5. Acceptable use

You may not, and you may not let a third party:

a) use the Service for unlawful purposes, or in breach of other people's rights; b) try to access other families' data, other people's accounts, or parts of the system you are not authorised to reach; c) reverse engineer, decompile, extract or copy the code, except to the extent that the law imperatively allows it; d) automate use of the Service, scrape data, or overload the infrastructure; e) get around usage limits, authentication or any security measure; f) impersonate another person, or use the verification module with someone else's documents; g) use the tracker module to watch over people you have no legal right to track; h) resell, sublicense or offer the Service as if it were your own; i) use the Service to provide health care, make clinical decisions or replace a mandatory health record.

6. Availability, backups, data loss and shutting the service down

6.1. No availability guarantee. The Service is offered with no uptime commitment, no service level agreement (SLA) and no continuity guarantee. It may be down, slow or unreachable because of maintenance, faults, updates, incidents at our infrastructure providers or causes beyond our control.

6.2. Changes to the Service. We may modify, suspend or discontinue any feature —including the AI adviser, identity verification, the tracker, the career module or the chat— at any time and without liability, trying to give notice whenever that is reasonably possible.

6.3. Backups: make your own. We make backups for operational purposes, but we do not guarantee that they exist, that they are intact, how often they are made, how old they are, or that they can be restored. Keeping your own copy of what matters to you is your responsibility. Use the export feature (Settings → Export my data) and keep your photos somewhere outside Arbo too.

6.4. Data loss. Data can be lost, corrupted or deleted through software or hardware faults, human error, security incidents, provider failures or the user's own mistakes. Better Planet is not answerable for the loss of User Content, to the fullest extent the law allows.

6.5. If the service shuts down. If we decide to discontinue Arbo, or if Better Planet ceases operating, we will endeavour to:

a) give at least 90 days' notice to each account's email address and inside the App; b) keep the ability to export your data available during that period; c) delete personal data from our systems and our backups within 30 days after the shutdown, unless a legal obligation says otherwise.

We cannot guarantee that we will meet these deadlines if the shutdown is abrupt and caused by force majeure, insolvency or a decision of an authority. Export your data regularly.

6.6. Change of control. If Better Planet is acquired or merged, or if it transfers the Service, personal data may be transferred to the acquirer, subject to the Privacy Policy in force and to applicable law. We will tell you.

7. Prices and payments

7.1. Arbo can be used for free. Some features are part of Arbo Premium, a monthly or annual subscription that covers the whole family; where it is available, the current price is shown in the App and in the store before you pay. The subscription is purchased and charged through Google Play or the App Store, renews automatically at the end of each period unless you cancel it at least 24 hours before, and you manage or cancel it from the subscription settings of your store account. If a free trial is offered, it is given once per store account and, if you do not cancel before it ends, the next period is charged. If you cancel, you keep Premium until the end of the period you have paid for; your data is not lost when the subscription ends.

7.2. Refunds for purchases made through the App Store or Google Play are governed by those stores' policies. Better Planet does not process those charges.

8. Intellectual property

8.1. The software, the "Arbo" brand, the design, the original texts, the educational content and the Service's databases belong to Better Planet or to its licensors, and are protected by intellectual property law.

8.2. We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on your devices, in accordance with these Terms.

8.3. The growth reference tables come from the World Health Organization, whose rights and terms of use are respected. The WHO does not sponsor, does not endorse and has no relationship whatsoever with Arbo or with Better Planet LLC, and is not answerable for the use this App makes of its tables.

8.4. The third-party trademarks mentioned (Apple, Google, Anthropic, Amazon Web Services, Render, Expo) belong to their owners. Mentioning them does not imply sponsorship or affiliation.

9. Third-party services

9.1. The Service depends on third parties: hosting, the language model, identity verification, federated sign-in, app stores and your phone's operating system.

9.2. Better Planet does not control those services and is not answerable for their availability, their accuracy, their price or policy changes, their failures or their security incidents, without prejudice to the obligations that data protection law places on us as data controller (see the Privacy Policy).

10. Warranties: the Service is provided "AS IS"

10.1. To the fullest extent permitted by applicable law, the Service, the App and all of their content are provided "AS IS" and "AS AVAILABLE", with no warranty of any kind, express, implied, statutory or otherwise.

10.2. To the fullest extent permitted by law, Better Planet expressly disclaims every implied warranty of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, accuracy, precision, reliability, continuous availability, freedom from errors, freedom from viruses and security.

10.3. In particular, we do not warrant that:

a) the Service will work without interruptions, without delays or without errors; b) notifications and reminders will be delivered, delivered on time or delivered in full; c) the calculations, percentiles, charts or analyses are accurate or suitable for your child; d) content generated by artificial intelligence is correct, useful or safe; e) the tracker positions are accurate, timely or present at all; f) data will be kept, will not be lost and can be recovered; g) the Service will meet your expectations or serve a particular purpose.

10.4. No oral or written statement from Better Planet, its staff or third parties creates a warranty that is not expressly set out in this document.

10.5. Legal limit of this clause. Some jurisdictions do not allow certain warranties to be excluded. In those cases, the exclusions above apply only to the extent permitted and do not affect consumers' non-waivable rights. See section 15.

11. Limitation of liability

This clause limits what you could claim from us. Read it carefully. To the fullest extent permitted by applicable law and without prejudice to section 15, which lists what cannot be excluded:

11.1. Exclusion of indirect damages. Better Planet, its partners, directors, employees, suppliers and licensors will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages, nor for lost profits, lost opportunity, lost data, lost reputation, moral damage or loss of use, even if we had been warned that they were possible and even if the agreed remedy fails of its essential purpose.

11.2. Specific exclusions. In particular, and again as far as the law allows, we will not be liable for damages arising from:

a) a medication reminder that did not arrive, arrived late or arrived twice, nor for missed, doubled, early or late doses, nor for their consequences; b) a decision about health, feeding, sleep, medication or development taken on the basis of information shown by the App, including curves and percentiles; c) incorrect content generated by artificial intelligence, or decisions taken on the basis of it, including career or educational decisions; d) the inaccuracy, delay or absence of a tracker position, or the fact that a physical device does not work; e) a wrong result from photo identity verification, in either direction; f) the loss, corruption or deletion of User Content; g) the unavailability, interruption or discontinuation of the Service or any of its features; h) unauthorised access to your account because of your credentials, your device or someone you invited; i) the conduct of other users, including the caregivers you invited; j) third-party failures: hosting, network, operating system, app store, AI provider, verification provider or chip manufacturer; k) use of the App by a minor without proper supervision.

11.3. Overall cap. As far as the law allows, Better Planet's total aggregate liability for any claim relating to the Service, on whatever basis (contract, tort, statute or otherwise), will not exceed the greater of these two amounts:

a) the total actually paid by you to Better Planet for the Service in the twelve (12) months before the event that gave rise to the claim; or b) USD 100 (one hundred US dollars).

If you use the Service for free, the cap is the one in point (b).

11.4. Allocation of risk. You acknowledge that these limitations are an essential element of the agreement and that without them the Service would not be offered, or would not be offered on these terms.

11.5. Mandatory limits. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including —depending on the jurisdiction— liability arising from wilful misconduct, gross negligence, fraud, death or personal injury, nor the non-waivable rights granted by consumer protection legislation. See section 15.

12. Indemnity

12.1. As far as the law allows, you undertake to defend, indemnify and hold harmless Better Planet, its partners, directors, employees and suppliers against any claim, demand, loss, liability, fine, damage, cost and reasonable expense (including lawyers' fees) arising from:

a) your breach of these Terms or of the law; b) the User Content you entered, including not having the right to record a minor's or a third party's data; c) use of the tracker module on a person you had no right to track; d) the use made of your account by the people you gave access to; e) a claim by the other parent, a guardian or the minor themselves about their data being recorded or processed in Arbo.

12.2. We may take over the exclusive defence of any matter subject to indemnity; if we do, you will cooperate with us reasonably.

12.3. This obligation does not apply where the claim arises from our own wilful misconduct or gross negligence, nor to the extent that the consumer law of your country prohibits it.

13. Suspension and termination

13.1. Termination by you. You can stop using Arbo whenever you want, sign out, delete your children's records and delete your account (Profile → Delete my account).

13.2. Termination by us. We may suspend or close your account, with prior notice where that is reasonable and without it where there is a legal, security or third-party risk, if you breach these Terms, if the use is fraudulent or unlawful, or if there are signs of harm to a minor.

13.3. Effects. On termination your licence to use the Service ends. We will delete or anonymise your data in accordance with the Privacy Policy. Sections 4.3–4.6, 8, 10, 11, 12, 14, 15 and 16 survive termination.

14. Governing law, venue and dispute resolution

14.1. Governing law. These Terms are governed by the laws of the State of New Mexico, United States, without applying their conflict of laws rules.

14.2. Venue. Any dispute will be submitted to the state and federal courts located in Bernalillo County, New Mexico. If you are a consumer and reside in the European Union, the European Economic Area or the United Kingdom, you keep the mandatory protections and the courts of your country of residence.

14.3. Contact us first. Before starting any action, we ask you to write to us at hola@arbofamily.com and give us thirty (30) days to resolve the matter in good faith. Many problems get sorted out that way.

14.4. No mandatory arbitration. Disputes are resolved before the courts indicated in 14.2. We do not ask you to give up your right to sue in court or to take part in class actions where the law allows you to.

14.5. Consumers. Nothing in this section deprives a consumer of the rights granted to them by the mandatory rules of their country of habitual residence, nor of the possibility of suing before that country's courts where the law allows it. For users resident in Chile, this expressly includes the rights under Law 19.496 and the jurisdiction of the local police courts of their domicile.

15. What these Terms CANNOT exclude

This section is as binding as the rest and prevails over any earlier clause that contradicts it.

15.1. Nothing in these Terms excludes or limits:

a) liability for wilful misconduct, fraud or gross negligence; b) liability for death or personal injury caused by our negligence, in jurisdictions where that limit is mandatory; c) consumers' non-waivable rights, including those under Chile's Law 19.496 on consumer protection. In Chile, article 16(e) strips of all effect any clause of absolute limitation of liability in adhesion contracts that could deprive the consumer of their right to compensation; d) the obligations that personal data protection legislation places on Better Planet as data controller —including, as the case may be, Chile's Law 21.719, the United States' COPPA and the European GDPR—, which cannot be shifted onto the user by contract; e) the obligations and warranties that Apple or Google impose on Better Planet for distributing the App in their stores, nor the rights those rules give the user. If these Terms contradict the store's rules, the store's rules prevail; f) any other liability that applicable law declares non-waivable.

15.2. If an authority decides that any exclusion or limitation is unenforceable, that clause will apply reduced to the maximum permitted and the rest will remain fully in force.

16. General provisions

16.1. Severability. If a clause is declared void, invalid or unenforceable, it will be interpreted —as far as possible— in a way that reflects the original intention within what is permitted; and if that is not possible, it will be treated as not written and the rest of the agreement will remain in full force.

16.2. No waiver. The fact that we do not exercise a right does not mean we are giving it up.

16.3. Assignment. You may not assign these Terms without our written consent. We may assign them to a successor or acquirer, giving you notice.

16.4. Entire agreement. These Terms and the Privacy Policy make up the complete agreement between the parties regarding the Service, and replace any earlier agreement.

16.5. Force majeure. We are not answerable for failures caused by events beyond our reasonable control: disasters, power or network outages, infrastructure provider failures, cyberattacks, acts of authority, conflicts or pandemics.

16.6. Changes to these Terms. We may change them. If the change is significant, we will give at least 30 days' notice by email and inside the App. If you do not agree, your remedy is to stop using the Service and delete your account. Using it after the change takes effect means you accept it. Under no circumstances will a change apply retroactively to a dispute that has already arisen.

16.7. Language. These Terms are published in Spanish, English, French and German. In case of discrepancy, for users resident in Chile and in Spanish-speaking countries the Spanish version prevails; for everyone else, the English version.

16.8. Contact. Better Planet LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA. General email: hola@arbofamily.com Privacy and data: privacy@arbofamily.com Website: https://arbofamily.com
